Police misconduct is a modern fact. Some officers disregard the rights of citizens and deserve to be sued. I have successfully helped some officers be brought to justice for their misconduct. but the government has wide latitude in these matters and many officers' actions are exempted by full or qualified immunities.
For an Officer to search your home or vehicle they must have a warrant, consent and/or emergency circumstances. To search your person you can add the implied consent of going through weapons scanners at the airport, amusement parks or courts. Upon a valid arrest these search powers are slightly higher as it includes any area where you could have reached and impound searches. Improper searches can be redressed by filing a Civil Action against the police officer and agency involved.
This can be a tricky basis to sue an officer as it depends upon the circumstances. Any resistance of an arrest could nullify a claim. Yet, even with the existing immunities an officer cannot rough you up over a traffic ticket without liability.
Do not plead guilty or no contest if you plan on suing an officer as this will nullify your claim.
