Dealing with construction is difficult. It prevents the full use of your home or business. Contractors can sue you for your breaches and apply mechanic's liens and prevent the refinancing and/or sale of your property. I make sure that you take control of the contract and do not leave leverage for them. Then, we negotiate and I attempt to get the contractor to comply. If not we go after the contractor in every way feasible so that you can get back to the full enjoyment of your property.
Contact me. I have worked with homeowners and business owners to resolve these disputes. I have also helped contractors fight against false claims. The contracts in these cases are so important that you really should have them reviewed before you sign. I can help you protect yourself and resolve many of these issues without litigation. My clients in this area often end up with significant judgments against their contractors.
Homeowners have rights above and beyond the rights of commercial space improvement contracts. Homeowners must be supplied with a lengthy and precise contract for it to be binding rather than voidable. Extra rules apply with the installation of residential swimming pools.
Construction is never on time or on budget, so what do you do as a business when a contractor is renovating space for you? You make sure that the contract clearly protects you in the case of lost business due to the inevitable delays of construction. I have protected companies from unnecessary delays and costs.
What if your contractor walks off of the job before it is completed? What if the job they did looks terrible? The contract will control, but there might also be liability for negligent workmanship. I can help you get the matter resolved short of and/or including litigation.
Construction Companies are bonded with the state. There are times when you can go after this bond, which allows for immediate payment and is highly unpleasant for the contractor who must pay a higher bond if their bond has been forfeited.
Homeowners can involve the Contractor's State Licensing Board (CSLB) to assist them in obtaining relief. However keep in mind the findings of the CSLB are not binding in the Courts. The Courts must independently decide the issues in each case.
