Good fences make good neighbors, but what if your neighbor's fence encroaches onto your property? Amazingly these type of disputes arise frequently. Reasonable parties can save expenses and split the costs to get a new fence on the property line. If this can be done, call me and we'll accomplish this, if not a lawsuit for trespassing to land is absolutely required to protect the property lines for the property you paid for and pay taxes for.
An easement is the right of another party to enter and utilize your property. Such cases can impose liabilities upon the landowner and the user of that land . For example, if the city owns a strip of land where there are trees planted, ho is responsible for the maintenance of that tree? Between City regulations and the ownership of that strip of land makes all of the difference. Similarly, what if two businesses have always used a shared driveway but a new owner wants to stop that practice? Without an easement you may at the whim of the new owner in that situation.
Sellers especially have duties to the buyer that may result in litigation if not demanded by your realtor. In some cases, such as selling property with improper square footage, there may be claims of fraud upon the buyer. I have represented buyers and sellers to resolve these issues with and without litigation.
Sometimes there are other claims of ownership that have to be addressed. I have assisted these claims and worked out some very good solutions for homeowners and equity-holders alike.
With individual homes costing so much, many of us are forced to live in condominiums and townhouses. In such communities the duly elected board and any management services are supposed to follow very specific laws. Experience shows that they do not always do so. Sometimes the board acts outside of its authority and breaks these rules. Either way, I have helped residents and their Boards resolve issues. When the boards do settle, their settlements are worthwhile.
State and Federal Laws control what banks can do with your mortgage monies. This includes impound accounts. Resolving these accounts can be as simple as a well directed letter or may require a trial of up to ten days length.
Whether residential or commercial people stay on properties after they have stopped paying rent. Other times, Landlords demand the end of a lease whether properly or improperly. I have helped landlords remove problem tenants. I have also helped prevent tenants from being improperly evicted.
